These Terms of Use (“Terms”) govern your access to and use of the DashDigital website, platform, applications, and services, including voice, SMS, messaging, automation, and customer engagement tools (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. About DashDigital
DashDigital (“DashDigital,” “we,” “us,” or “our”) provides AI-powered voice, text, messaging, automation, and CRM-integrated customer communication services for businesses.
DashDigital is not a telecommunications carrier and does not provide emergency services (e.g., 911).
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms. By using the Services, you represent that you meet these requirements.
3. Account Responsibilities
You are responsible for:
Maintaining the confidentiality of your account credentials
All activity conducted through your account
Ensuring all data, contacts, and messaging uploaded or sent through the Services comply with applicable laws and regulations
4. Acceptable Use Policy
You agree NOT to use the Services to:
Send spam, unsolicited, or bulk messages without proper consent
Violate A2P 10DLC, TCPA, CTIA, or carrier rules
Engage in fraudulent, deceptive, or misleading practices
Send prohibited content, including but not limited to:
Illegal goods or services
Hate, harassment, or threats
Malware or phishing attempts
DashDigital reserves the right to suspend or terminate accounts that violate these Terms or carrier requirements.
5. SMS, Voice, and Messaging Compliance (A2P / 10DLC)
User Responsibility for Consent
You are solely responsible for obtaining and maintaining proper, verifiable opt-in consent from recipients before sending SMS, MMS, or voice communications using the Services.
You represent and warrant that:
Each recipient has expressly consented to receive messages
Consent records are retained as required by law
Messages sent match the purpose disclosed at opt-in
Opt-Out Handling
DashDigital automatically supports industry-standard opt-out commands such as STOP, END, CANCEL, UNSUBSCRIBE, and QUIT where technically feasible.
You agree not to interfere with or override opt-out functionality.
6. Message Content and Frequency
You agree that:
Message content must accurately reflect your business and services
Message frequency must be reasonable and consistent with user expectations
Messages must not be misleading, deceptive, or abusive
Message frequency may vary depending on interaction and configuration.
7. Carrier Disclosures
You acknowledge that:
Message and data rates may apply
Wireless carriers are not liable for delayed or undelivered messages
Delivery is subject to carrier filtering, availability, and network conditions
DashDigital does not guarantee message delivery.
8. Prohibited Messaging Uses
You may not use the Services for:
Purchased, rented, or scraped contact lists
Lead generation without documented opt-in
High-risk content disallowed by carriers, including:
Cannabis (where prohibited)
Payday or short-term loans
Debt relief (without required disclosures)
Gambling (where restricted)
Political messaging (without proper registration)
9. Data Usage and Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how data is collected, used, and protected.
Mobile information will not be shared with third parties for marketing or promotional purposes.
Opt-in and consent data will not be sold or rented.
10. Service Availability
We strive to maintain reliable Services but do not guarantee uninterrupted or error-free operation. Services may be modified, suspended, or discontinued at any time.
11. Fees and Billing
Fees, billing cycles, and payment terms are outlined in your service agreement or order form. Failure to pay may result in suspension or termination.
12. Intellectual Property
All DashDigital software, content, trademarks, and intellectual property remain the exclusive property of DashDigital. You may not copy, reverse engineer, or resell the Services without written permission.
13. Termination
DashDigital may suspend or terminate your access:
For violations of these Terms
For carrier or regulatory non-compliance
To protect system integrity or legal obligations
Upon termination, your right to use the Services immediately ends.
14. Disclaimer of Warranties
The Services are provided “as is” and “as available.” DashDigital disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
15. Limitation of Liability
To the maximum extent permitted by law, DashDigital shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or data, arising from use of the Services.
16. Indemnification
You agree to indemnify and hold harmless DashDigital from claims, damages, or penalties arising from:
Your use of the Services
Your messaging content
Your failure to obtain proper consent
Violations of A2P, TCPA, CTIA, or carrier rules
17. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of law principles.
18. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
